§ 11-7. Fireworks—Defined, sale and possession prohibited.

  • (a)

    The term "fireworks," as used in this section, shall mean and include any combustible or explosive composition, or any substance, combination of substances or articles prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration or detonation, and shall include blank cartridges, toy pistols, toy cannons, toy canes, or toy guns in which explosives are used, the type of balloons which require fire underneath to propel same, fireworks, torpedoes, skyrockets, Roman candles, Dago bombs, sparklers or other fireworks of like construction and any fireworks containing any explosive or flammable compound, or any tablets of other device containing any explosive substance. Nothing in this section shall be constructed as applying to the sale of toy pistols, to canes, toy guns or other devices in which paper caps manufactured in accordance with United States Interstate Commerce Commission regulations for packing and shipping toy paper caps are used and toy pistol paper caps.

    (b)

    It shall be unlawful to sell any fireworks within the city.

    (c)

    It shall be unlawful to ignite, discharge, explode or detonate any fireworks within the city.

    (d)

    It shall be unlawful to possess any fireworks within the city.

    (e)

    The board of mayor and aldermen may authorize a fireworks display by a government entity with "government entity" defined as "the State of Mississippi, a county, municipality, school district, public hospital or other political subdivision of the State of Mississippi" for special events and holidays. A fireworks display is a presentation of fireworks for public gatherings. Before authorization is given, the entity applying or requesting the fireworks display shall present proof of acceptable insurance coverage being a general liability/accident policy in an amount determined by the board of mayor and aldermen and shall present proof acceptable to the board of mayor and aldermen that said entity has hired an individual or company experienced in the handling of fireworks and/or displays and the members of the public attending such exhibition shall be kept at a safe distance therefrom. The City of Yazoo City Fire Marshal's Office may inspect all fireworks displays/exhibitions once display is set up to discharge.
